1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "Customer") and JCAM Global LLC d/b/a Rystik ("Rystik," "we," "us," or "our") governing your access to and use of the rystik.com website, the Rystik AI receptionist platform, and all related services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.
2. Description of Service
Rystik provides an AI-powered virtual receptionist platform that answers phone calls, qualifies leads, books appointments, captures contact information, and sends transactional text messages on behalf of our customers. The Service includes an online dashboard for managing leads, call recordings, transcripts, automation workflows, and business settings.
3. Account Registration
To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.
You must be at least 18 years of age to create an account and use the Service. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
4. Subscription Plans and Billing
The Service is offered on a subscription basis with various plan tiers. By subscribing to a plan, you agree to pay the applicable fees as described on our pricing page. All fees are billed in advance on a monthly basis and are non-refundable except as required by law.
We reserve the right to change our pricing at any time. We will provide at least 30 days' notice of any price changes. Your continued use of the Service after a price change constitutes acceptance of the new pricing.
Payment is processed securely through Stripe. You authorize us to charge your payment method on file for all fees incurred. If payment fails, we may suspend your account until payment is received.
5. Refund Policy
All plans include a 14-day money-back guarantee. If you are not satisfied with the service, contact us within 14 days of your initial subscription for a full refund. Refunds are processed to the original payment method within 5-10 business days.
6. Phone Numbers and Telephony
As part of the Service, we may provision phone numbers for your use through our telephony provider (Twilio). These phone numbers are provisioned on your behalf and remain the property of the telephony provider. You agree to use provisioned phone numbers only for legitimate business purposes and in compliance with all applicable laws and regulations.
You are responsible for configuring call forwarding from your existing business phone number if applicable. We are not responsible for any issues arising from your phone carrier's forwarding settings.
7. Call Recording and Consent
The Service records and transcribes phone calls handled by our AI receptionist. You acknowledge and agree that:
You are responsible for compliance with all applicable federal and state laws regarding call recording, including but not limited to one-party and two-party consent laws. In states that require all-party consent, you are responsible for ensuring callers are informed that their call may be recorded (e.g., through an IVR greeting or verbal notice).
Call recordings and transcripts are stored securely and are accessible through your account dashboard. You may delete recordings at any time through the Service. Upon account termination, recordings are deleted within 90 days.
8. SMS/Text Messaging Terms
The Service may send text messages (SMS/MMS) on your behalf to your customers and leads. By using the SMS features of the Service, you agree to the following:
8.1 Compliance with Laws
You agree to comply with all applicable laws and regulations governing text messaging, including the Telephone Consumer Protection Act (TCPA), the CTIA Messaging Principles and Best Practices, and all carrier requirements for A2P 10DLC messaging.
8.2 Consent Requirements
You are responsible for ensuring that all recipients of text messages sent through the Service have provided proper consent to receive such messages. Consent may be obtained through verbal consent during inbound phone calls or written consent through web forms or other documented methods. You must maintain records of consent for each recipient.
8.3 Message Content
Text messages sent through the Service are limited to transactional messages directly related to a caller's inquiry, including appointment confirmations, reminders, dispatch notifications, and follow-ups. You agree not to use the Service to send unsolicited marketing messages, spam, or messages containing prohibited content as defined by carrier guidelines.
8.4 Opt-Out Handling
The Service automatically processes opt-out requests. When a recipient replies STOP to any message, no further messages will be sent to that number. You agree not to circumvent or override opt-out requests. Opt-out compliance is handled automatically by our platform.
8.5 Message Rates
Standard message and data rates may apply to recipients of text messages sent through the Service. You acknowledge that messaging fees may be included in your subscription or billed separately based on usage.
8.6 No Sharing of Mobile Data
We do not sell, share, or disclose mobile phone numbers or SMS opt-in data to third parties or affiliates for marketing or promotional purposes. This applies to all data collected through the SMS messaging features of the Service.
9. Acceptable Use
You agree not to use the Service to: violate any applicable law or regulation, impersonate any person or entity, send spam, unsolicited messages, or prohibited content, interfere with or disrupt the Service or its infrastructure, attempt to gain unauthorized access to the Service or other users' accounts, use the Service for any illegal, harmful, or fraudulent purpose, harvest or collect personal information of callers for purposes unrelated to the Service, or resell or redistribute the Service without authorization (except under an Agency plan).
10. Agency and White-Label Terms
If you subscribe to an Agency plan, you may offer the Service to your own clients under your brand (white-label). As an agency, you are responsible for: ensuring your clients comply with these Terms and our Privacy Policy, managing your clients' accounts and configurations, ensuring proper SMS consent is obtained for all end-users of your clients, and any liability arising from your clients' use of the Service.
We reserve the right to suspend or terminate your Agency account if any of your clients violate these Terms.
11. Data Ownership
You retain ownership of all data you provide to the Service, including your business information, knowledge base content, and customer data. We retain ownership of the Service, its technology, AI models, and all intellectual property related to the platform.
You grant us a limited, non-exclusive license to use your data solely for the purpose of providing the Service. Upon account termination, you may request an export of your data within 30 days.
12. Intellectual Property
The Service, including all software, design, text, graphics, logos, and other content, is owned by Rystik and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
The name "Rystik" as used in the context of our AI receptionist, the Rystik name and logo, and all related trademarks are the property of JCAM Global LLC.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
While our AI receptionist is designed to handle calls professionally and accurately, we do not guarantee that every call will be handled perfectly. AI-generated responses may occasionally be inaccurate or inappropriate. You are responsible for reviewing call transcripts and lead data for accuracy.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RYSTIK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
15. Indemnification
You agree to indemnify, defend, and hold harmless Rystik and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to: your use of the Service, your violation of these Terms, your violation of any applicable law or regulation (including TCPA and call recording laws), any claims by third parties related to calls or messages sent through your account, or your failure to obtain proper consent for call recording or text messaging.
16. Termination
You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period. No refunds will be issued for partial months.
We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, engaged in fraudulent or illegal activity, or if your use of the Service poses a risk to our platform or other users. We will provide notice of termination when reasonably possible.
Upon termination, your access to the Service will cease. Data associated with your account will be retained for 90 days, during which you may request an export. After 90 days, all data will be permanently deleted.
17. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page, updating the "Last updated" date, and/or sending you an email notification. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Orange County, California.
19. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Rystik regarding the Service and supersede all prior agreements, representations, and understandings.
